Privacy

Guard Up respects your privacy. Any information you enter during the course of being on our site whether it be credit card information, billing, shipping addresses, or e-mail addresses, will be held with the utmost respect toward privacy. We do not sell, trade or give away our customer database to any third party marketing companies.

Shipping

All items are shipped UPS or USPS within 1-4 weeks, depending on availability.  If you need a rush order, call (781) 270-4800 to see if possible.  Rush fee may apply.  Shipping rates are as follows:

Single DVD = $5.00
0 to 59.99 = $9.00
60.00 to 99.99 = $12.00
100.00 to 149.99 = $16.00
150.00 to 199.99 = $20.00
200.00 up = Varies

Returns/Exchanges

Returns are accepted up to 30 calendar days after receipt of the merchandise. Returns or exchanges that are received damaged, soiled, torn, worn, or used will not be accepted back.

Please call (781) 270-4800 for a Return Authorization Number and then send the merchandise to Guard Up paid and insured. Please include a note explaining the reason for the return.  We will replace defective items with the same product, where available. If an exact replacement is not available, we will replace the product with a like item or suitable substitute.

When exchanging merchandise, please give details about the exchange. You will be charged a minimum of $5 for shipping the exchange back to you. If the exchange is not due to defective merchandise or our mistake, you will be charged a 20% restocking fee and all shipping.  Make sure to include the number of the original invoice that was sent with your original order.

Please be informed that our DVDs and CDs are non-refundable. Items can be exchanged for the same title, if defective or damaged upon receipt. 

Wholesale

Guidelines & Liability Disclaimer

Sparring Gear, Fencing Gear & Training Accessories are intended only to reduce the risk & severity of accidental injury to protected areas during supervised, no contact or light contact sparring or training.  Light contact/force does not cause pain, injury, penetration, or visible movement of the opponent.  All sparring/fencing participants should wear full sets of protective equipment.  Sparring/Fencing gear is intended for instructional sparring/fencing only & not for other, or more intense uses such as moderate to full contact sparring, boxing, bag work, weapons training, other sports including soccer, or for medical purposes.

Practice Weapons are for training only under expert supervision, for demonstration or forms, for collection, or display.  Weapons training requires: appropriate safety gear, including head, face, eye, & mouth protection & other guards suitable for the particular weapon & techniques being practiced & a safe training environment set up to avoid injury to people & objects.  To decrease chances of injury, user should respect the weapon(s) and inspect them before each use to ensure they are in proper condition.  We recommend that instructors limit children & beginners to the use of foam rubber or foam-covered practice weapons.  Some weapons may be illegal in user's area; user must research & follow state & local laws.  Guard Up is not responsible for improper or illegal use or modification of weapons or any training equipment.  Weapons will not be sold to anyone under 18 years of age.

Assumption of the Risk

By buying Guard Up's products, you understand and agree that martial arts, fencing, swordsmanship, competition and demonstrations are high risk activities and, to the extent permitted by law, YOU EXPRESSLY AND VOLUNTARILY ASSUME THE RISK OF DEATH OR OTHER PERSONAL INJURY SUSTAINED WHILE PARTICIPATING IN SUCH ACTIVITIES WHETHER OR NOT CAUSED BY THE NEGLIGENCE OR OTHER FAULT of Guard Up including but not limited to equipment malfunction from whatever cause, or any other fault of Guard Up.  Additionally, you agree to indemnify, defend and hold Guard Up harmless from any third party claims arising from such High Risk Activities or Training Weapons or any other Guard Up product.

Limited Replacement Warranty              

Guard Up warrants its products to be free from defects in materials and workmanship for a period of 30 days from date of purchase, provided they have not been subjected to obvious abuse, neglect or misuse. Guard Up's sole liability is limited to repairing or replacing products that are returned prepaid to Guard Up within this 30-day period, unless specific product literature specifies otherwise.  Products produced by other manufacturers carry their own warranty and are serviced by the customer contacting that manufacturer.  Due to vendor requirements, books and videos cannot be refunded once the seal is broken.  Guard Up's warranty as to books and videos is limited to exchange for the same title if the tape or book proves defective. THE ABOVE STATED WARRANTIES ARE IN LIEU OF ALL OTHER WARRANTIES EXPRESSED OR IMPLIED INCLUDING THE WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE AND OF ALL OTHER OBLIGATIONS AND LIABILITIES OF GUARD UP.  GUARD UP NEITHER ASSUMES, NOR AUTHORIZES ANY OTHER PERSON TO ASSUME FOR IT, ANY OTHER LIABILITY IN CONNECTION WITH THE SALE OF PRODUCTS FROM ITS WEBSITE, CATALOG OR OTHERWISE.  THE ABOVE LIMITED WARRANTIES SHALL NOT APPLY TO ANY PRODUCT WHICH HAS BEEN SUBJECT TO ACCIDENT, NEGLIGENCE, ALTERATION, ABUSE, OR MISUSE.  THE TERM "ORIGINAL PURCHASER" AS USED IN THIS WARRANTY MEANS THE PERSON TO WHOM THE PRODUCT IS ORIGINALLY SOLD AS SHOWN ON THE SALES INVOICE.  THESE WARRANTIES SHALL APPLY ONLY WITHIN THE BOUNDARIES OF THE UNITED STATES AND CANADA.

Limitation of Liability

As set forth above under the limited warranty provisions, Guard Up's liability is limited to repair or replacement of its products which are returned to it prepaid in the specified period of time.  In no event shall Guard Up's liability exceed the value of the products sold.  Guard Up shall not be liable for any special or consequential damages that result from the use of any product sold through this website or through its catalog.  Applicable law may not allow the limitation or exclusion of liability of special or consequential damages so the above limitation or exclusion may not apply to your purchase, but it is intended to be the maximum limitation as permitted by law.

Guard Up is not liable for any typographical errors on the web site or information given.  Prices are subject to change.  Availability of merchandise may change. We do not guarantee the availability of products on this website. No rain checks will be given. Although many hours have been spent on providing the most current and up to date information on this website and on the Online Store we cannot and will not warrant any price or any availability on our online system.  Guard Up reserves the right to reject any orders placed for a product listed at an incorrect price.  If you discover an error in our website or catalog, please let us know.
